High Court in Kampala awards Shs10 million to man held by police beyond 48 hours before charge

Justice & Court Rulings Disputed Kampala Mar 2026 (day not reported) Severity: 1/5

According to The Independent, High Court Judge Joyce Kavuma ruled that a suspect's detention by police beyond the constitutional 48-hour limit before being charged was unlawful and awarded him UGX 10 million. The applicant said he was arrested on 20 November 2024, held at the Kireka Flying Squad facility and Kampala Central Police Station, and only produced in court on 29 November 2024. The judge rejected the police explanation of a weekend arrest and incomplete investigations, but declined to dismiss the charges, finding the torture allegation not proved.

Disputed: The applicant says police tortured him in custody; the police investigating officer denied this, saying his injuries came from a scuffle during the alleged assault, and the court found torture not proved.
